CPD – An overview of the new bargaining reforms by Deputy President Peter Hampton


Fair Work Act bargaining reforms – an update on the implementation and operation of the 6 June 2023 changes.

 

The FWC’s national practice leader for bargaining will provide an insight into the many significant changes, including those impacting upon protected industrial action ballots and multi-employer agreements, and provide an overview of the leading decisions of the Commission.

Peter Hampton is a Deputy President of the Fair Work Commission based in Adelaide, having been appointed as a Commissioner in January 2010 and elevated to Deputy President in October 2022. In this capacity he is also a Member of the Expert Panel for Annual Wage Reviews, which is responsible for setting minimum and award wages in Australia, and he also hears matters in almost all of the other jurisdictions handled by the Commission, including its appellant functions.

Immediately prior to this appointment, Peter was Director of Policy and Strategy for SafeWork SA, the SA Department of the Premier and Cabinet. Prior to joining SafeWork SA in 2006, he was for 12 years a Deputy President of the South Australian Industrial Relations Commission and in a dual capacity for ten of those years as a Deputy President of the Australian Industrial Relations Commission.

In the sixteen years prior to joining the Commission, Peter held various positions in the South Australian business community including as Deputy Director of the SA Employers’ Federation Inc and General Manager, Human Resource Management Services with what is now Business SA.

Peter is a Life Member and former National President of the Australia Labour and Employment Relations Association and a Life Member and former President of the Industrial Relations Society of South Australia (ALERA SA).

Peter is a nationally accredited mediator and is a member of various professional bodies, including Australian Labour Law Association, Resolution Australia, the Council of Australian Tribunals and the International Association on Workplace Bullying and Harassment.

Peter was appointed by the President as Panel Head/National Practice Leader for the then new anti-bullying jurisdiction in November 2013 and continued in that role until 2020. He is now the National Practice Leader (NPL) of the Commission’s Bargaining jurisdiction; and separately, NPL for what is now known as the Collaborative Approaches Program that utilises interest-based dispute resolution and bargaining processes. He is also a member of the Commission’s Rules and Professional Development committees.
